Public Offer Agreement

SOLE PROPRIETOR Yakovchuk Daria Dmytrivna, acting in accordance with the current legislation of Ukraine, hereinafter referred to as the "Seller", publishes this Public Offer Agreement for the sale of goods through the online store https://spacebrand.store (hereinafter — the "Website").

 

This Agreement is a public offer in accordance with Article 633 of the Civil Code of Ukraine and has the same legal force for all Buyers without exception.

 

1. GENERAL PROVISIONS

1.1. This Agreement defines the procedure for the sale of goods by the Seller through the Website, as well as the rights and obligations of the Seller and the Buyer.

1.2. The fact of placing an order on the Website is considered acceptance (full and unconditional acceptance) of this offer.

 

2. PARTIES TO THE AGREEMENT

2.2. Buyer — an individual or legal entity who has accepted this offer and placed an order for goods through the Website.

 

3. SUBJECT OF THE AGREEMENT

3.1. The Seller undertakes to transfer ownership of the goods presented on the Website to the Buyer, and the Buyer undertakes to pay for and accept such goods under the terms of this Agreement.

 

4. PAYMENT PROCEDURE

4.1. Payment for the goods is made by the Buyer in a non-cash form: by bank card, through payment systems, or by other methods specified on the Website. Cash payment is not provided.

 

5. DELIVERY AND RECEIPT OF GOODS

5.1. The Buyer receives the Goods through delivery or in person. The procedure for payment and receipt is specified on the corresponding page of the Website.

5.2. When delivering Goods to other cities of Ukraine or abroad, carried out by Carrier Companies, the Buyer agrees to their Shipping Rules.

5.3. Receipt of the Goods and the absence of claims regarding their quality is confirmed by the Buyer’s signature on the consignment note, carrier’s declaration, or delivery note.

5.4. All questions arising in the process of payment and receipt of the Goods can be clarified by the Buyer using the contacts indicated on the Website in the "Contacts" section.

 

6. RETURN AND EXCHANGE OF GOODS

6.1. In accordance with Article 9 of the Law of Ukraine "On Consumer Rights Protection", the Buyer has the right to exchange or terminate the purchase agreement in the event of:

- preservation of the product’s appearance, consumer properties, seals, and labels;

- availability of the receipt or other payment document;

- compliance with the fourteen-day period from the moment of receipt of the goods.

 

7. PERSONAL DATA

7.1. The Buyer consents to the Seller processing their personal data in accordance with the Law of Ukraine "On Personal Data Protection".

7.2. The data is used for the purpose of fulfilling this Agreement, as well as informing the Buyer about new offers from the Seller.

7.3. The Seller undertakes not to transfer personal data to third parties without the Buyer’s consent, except as provided by law.

 

8. OTHER TERMS

8.1. This Agreement enters into force upon acceptance of the offer by the Buyer and remains valid until full performance of the obligations by the Parties.

8.2. The Seller has the right to make changes to this Agreement without prior agreement with the Buyer. The current version is always available on the Website.

8.3. All disputes are resolved through negotiations, and if no agreement is reached — in court in accordance with the current legislation of Ukraine.
